Terms of service

These terms govern your use of the Tuckly website and the Tuckly gym management service (the "Service") provided by Tuckly Technologies ("Tuckly"). By creating an account or using the Service you agree to these terms on behalf of yourself and the gym or business you represent.

1. The Service

Tuckly provides cloud software for managing members, payments, attendance, classes, communications, invoicing and reporting, together with mobile apps and integrations. We may add, change or retire features over time; we will give reasonable notice of material changes that reduce functionality.

2. Accounts

You must provide accurate information, keep your login credentials secure and be responsible for all activity under your account, including staff logins you create. Tell us immediately at support@tuckly.co if you suspect unauthorised access.

3. Subscriptions, trials and billing

• Plans are billed monthly or annually in advance in the currency shown for your region (SGD for Singapore). Prices exclude GST and other applicable taxes, which are added to your invoice.
• Free trials convert to a paid plan only when you choose a plan and add a payment method. We do not charge automatically at the end of a trial.
• Plan limits (active members, locations, staff) are described on the pricing page. If you exceed them we will ask you to upgrade.
• You may cancel at any time from your billing settings; the Service continues until the end of the paid period. Refunds are governed by our refund policy.
• We may change prices with at least 30 days' notice; changes apply from your next renewal.

4. Payments to your gym

Member payments are processed by third-party payment gateways under your own merchant account and their terms. Tuckly does not hold funds, does not add transaction fees and is not responsible for gateway availability, chargebacks or settlement timing.

5. Your data and your members

You own the data you and your members enter into Tuckly. You grant us a licence to host and process it to provide the Service. You are responsible for having a lawful basis to collect and use your members' data, for obtaining consents required for messaging (including WhatsApp and SMS), and for complying with privacy, consumer and tax laws that apply to your gym. We process data as described in our privacy policy.

6. Acceptable use

You agree not to use the Service to send spam or unlawful messages, to store content that infringes others' rights, to attempt to access other customers' data, to reverse engineer the Service or to resell it without a partner agreement.

7. Availability and support

We aim for 99.9% monthly uptime excluding scheduled maintenance, and provide support by email, chat and (on eligible plans) phone and WhatsApp. Service credits, where offered, are described in your plan or enterprise agreement.

8. Intellectual property

Tuckly and its software, design and content are owned by Tuckly Technologies and its licensors. These terms do not transfer any ownership to you. Feedback you give us may be used without obligation.

9. Warranties and liability

The Service is provided "as is" to the fullest extent permitted by law. To the extent permitted by law, Tuckly's total liability for any claim is limited to the fees you paid in the 12 months before the claim, and Tuckly is not liable for indirect or consequential losses, including lost revenue. Nothing in these terms limits liability that cannot be limited by law.

10. Termination

You may close your account at any time and export your data beforehand. We may suspend or terminate accounts that breach these terms or remain unpaid after notice. After termination we retain data only as described in the privacy policy.

11. General

These terms are governed by the laws of the jurisdiction in which Tuckly Technologies is registered, unless a signed enterprise agreement states otherwise, and disputes will be resolved in the courts of that jurisdiction. If any provision is unenforceable the rest remains in effect. We may update these terms; continued use after notice means acceptance. Contact: hello@tuckly.co.
